Jury selected for Fraga retrial in Nobles County
WORTHINGTON — According to the Nobles County Attorney’s office, the final junior was selected after almost five days of questioning and selection for the retrial of Josue Fraga.
Each prospective juror was asked individually about their knowledge of the case, which first went to trial in 2009. On Friday, an employee in the Nobles County Attorney’s office said 12 jurors and two alternates had been selected.
Opening statements are scheduled to begin at 9 a.m. Monday, and the trial is expected to last through Sept. 27.
Fraga was convicted of first-degree murder in a jury trial for the death of his niece, Samantha, in May 2009, after she was murdered in March 2008. He was sentenced to life in prison without parole. An order for a new trial was granted in June 2012 after new evidence was discovered.
During the first trial, Fraga’s defense attorneys tried to cast blame on Fraga’s then 13-year-old son, who denied during testimony ever touching the child sexually.
Fraga’s son and oldest daughter are expected take the stand during the second trial and share new information.
