WORTHINGTON — A Worthington man filed a written petition to enter a plea of guilty to a third-degree sexual conduct charge Monday.

Jose Bonilla, 42, was arrested back in December on four counts of third- and fourth-degree sexual conduct when Worthington police officers responded to a report of a possible domestic assault in progress on Clary Street.

When police arrived, they were escorted to a lower level of the home, where they allegedly found the victim’s boyfriend sitting on top of Bonilla. When officers assisted Bonilla to his feet, they noticed his pants were unzipped and that he smelled strongly of alcohol.

The victim alleged in the criminal complaint that she was sleeping downstairs in her boyfriend’s bed when she woke up to find someone touching her body and private parts.

She then saw it was not her boyfriend and ran upstairs to alert him that she had been raped. Her boyfriend then ran downstairs and allegedly found Bonilla hiding in the boiler room, where he held him down until police arrived.

Bonilla was booked into Nobles County Jail that night.

The petition filed Monday states that in exchange for a guilty plea on count three of the sexual criminal conduct charges, the rest would be dismissed.

If the plea is accepted by the court, Bonilla will be placed on probation for 15 years following the conditions that he serve one year in Nobles County Jail, complete a chemical dependency evaluation and a sex offender assessment. If determined by that assessment, Bonilla will enter a sex offender treatment program.

The petition will be considered by the court at a March 3 hearing.
