WORTHINGTON — Scheduled to go on trial for first-degree methamphetamine possession in less than two weeks, James Naab now faces four more felony drug charges in a separate case filed Tuesday in Nobles County District Court.
The new charges actually stem from an incident that took place in late October, when agents from the Buffalo Ridge Drug Task Force arrived at Naab’s residence to arrest him.
Naab was out on bail after being charged with meth possession in August 2008. His conditions of release included random testing and no use of alcohol or controlled substances.
During a pat-down search of Naab, an agent located a black pouch that field tested positive for .5 grams of meth.
Naab indicated he wanted to alert someone in his house that he was going to jail, so he and the agent went inside. The agent saw an item used to store marijuana on the dining room table and asked for permission to search. Naab refused, telling the agent he would need a warrant.
One agent secured the house while another went to apply for a warrant. The application was granted and executed. During the search, agents found a plastic baggie of marijuana, a digital scale, several pipes, two shotguns and a pistol. Inside the living room was an M&M container with a glass pipe inside, The pipe contained meth residue. Agents also located a pill bottle containing a few Schedule II and III prescription medications.
Naab was taken into custody, where he remained until mid-November. He was eventually released on the earlier bail amount and several conditions were attached, including abstinence from narcotics with scheduled testing twice a week at the probation department.
The trial on the initial 2008 drug charges, in which authorities located meth and marijuana in his home, begins Jan. 27 and is scheduled to take two days.
