Notice of Hearing - County Ditch No. 12 - Apr. 3, 2012

PETITION OF STATE OF MINNESOTA, BY THOMAS K. SOREL, ITS COMMISSIONER OF TRANSPORTATION, FOR THE RIGHT TO MAKE MINOR ALTERATIONS OR CHANGES IN COUNTY DITCH NO. 12 IN NOBLES COUNTY

NOTICE OF HEARING

TO ALL PERSONS INTERESTED IN COUNTY DITCH NO. 12 IN NOBLES COUNTY:

YOU AND EACH OF YOU WILL PLEASE TAKE NOTICE that the State of Minnesota, by Thomas K. Sorel, its Commissioner of Transportation, has filed a Petition with the County Ditch authority of Nobles County, pursuant to Minnesota Stat. 161.28, praying that he be allowed to make minor alterations or changes in County Ditch No. 12. That attached to said Petition now on file is a plan description of the minor alterations or changes petitioned for. That the portion of said County Ditch No. 12 which is proposed to be changed or altered by maps and plans attached to said Petition.

That said Petition alleges that it is advantageous and desirable in the construction and maintenance of Trunk Highway No. 59 that said minor alterations or changes be made, and that said minor alterations or changes petitioned for will not affect the functioning nor impair the efficiency of said County Ditch No. 12.

APPROXIMATE LOCATION AND PROPOSED CONSTRUCTION OVER COUNTY DITCH NO. 12.

S.P. 5304-37 (Trunk Highway 59 Nobles County)

This construction will take place where Trunk Highway 59 crosses County Ditch No. 12 on the north side of Worthington. The crossing is on Trunk Highway 59 between I-90 and 27th Street. This is located between Sections 13 and 14, Township 102 North, Range 40 West, in Nobles County, Minnesota. The proposal is to replace an existing concrete culvert crossing and to relocate a portion of the open ditch to accommodate Trunk Highway 59 improvements.

YOU WILL FURTHER TAKE NOTICE that said Petition will be presented to the County Ditch Authority at the Nobles County Government Center, 315 10th Street in Worthington, Minnesota on the 3rd day of April, 2012 at 9:00 a.m. at which time all persons interested in said ditch system may appear and be heard and present arguments for or against the granting of said Petition.
