WINDOM — A Windom man is expected to make a court appearance next week in response to a charge of possession of pornographic material.
The criminal complaint, filed last week, states Duane Stanley Hirsch, also known as Tyler Josh Harley, 44, of Windom, is accused of possessing a VHS tape containing child pornography.
According to the court document, authorities were contacted July 15 by a woman who was cleaning out her house in anticipation of moving.
While looking for several video tapes of herself and Harley, her ex-boyfriend, she found a standard black tape with a handwritten note.
She recognized the handwriting as Harley’s, who had moved out of the house a few weeks earlier.
She watched the video, and told authorities it was filled with still photos that were mostly pornographic in nature and had numerous young girls doing sexual acts.
She said she became especially concerned when she realized she recognized pictures of children she knew interspersed with the pornography.
There were also photos of Windom girls at the local pool, she said, wearing bikinis. Based upon the children’s ages, she thought the video had been created approximately 8 years ago.
An officer with the Windom Police Department watched the video, and noted the pictures taken at the pool were likely taken without the participants’ knowledge while the photographer sat in the parking lot.
The officer took possession of the tape, and was told there were approximately 1,000 videotapes in the basement and bedroom.
When Harley moved out, the woman said, he took several tapes with him.
There was also a computer in the basement he used, and the woman gave the officer permission to take the computer and any videos.
There were 14 totes in the basement filled with tapes, and about 600 were taken into evidence.
The officer decided to take only those that were non-commercial or unlabeled.
While moving the computer from the desk, the officer saw a notebook fall.
When she picked it up, she noted it was open to a page that listed a long list of pornographic topics and websites that included the words “naked very young little virgin” and “child sex pictures.”
The officer paged through the rest of the notebook and found more porn websites and instructions on how to grow marijuana.
Harley/Hirsch was arrested, and bail was set at $5,000. Conditions of release include no access to Internet, no contact with persons under the age of 18 and exclusion from the Windom pool, parks, schools, beaches and churches.
He was granted a public defender.
Under the name Hirsch, there are previous convictions for contributing to the delinquency of a minor from Cottonwood County in 1992, and second-degree burglary from Cottonwood and Jackson County in 1995.
He was sentenced to 38 months incarceration.
As Harley, he was convicted for theft in 1997, driving while impaired in 1999 and third-degree burglary in 2009.
The 2009 conviction was in Nobles County, where he was given a sentence of 21 months, stayed on the condition he serve 120 days in jail and five years of probation.
