NOTICE OF PUBLIC HEARING

The City of Worthington Planning Commission will hold three public hearings on Tuesday, July 6, 2010, for the purpose of considering the following Planning Commission business:

Conditional Use Permit - Mick Eggers is seeking the issuance of a special use permit for property owned by Bridgestone Americas Holdings at 405 10th Street. If approved, the applicant would be allowed to operate an automotive repair business on the subject property. The property is located within the Retail Shopping Overlay District. The purpose of the District, which consists of the properties along 10th Street between 2nd and 5th Avenues (including the subject property), is to give preference to ground level retail and entertainment land uses. Any other land use permissible or permissible by conditional use, including the proposed business, in the "B-2" - Central Business District are allowed only through the issuance of a conditional use permit. The legal description of the subject property under consideration is as follows:

Lots 16, 17, 18, & 19, Block 18, Plat of Worthington, City of Worthington, Nobles County, Minnesota

AND

The vacated alley lying between Lots 17 & 18, Block 18, Plat of Worthington, City of Worthington, Nobles County, Minnesota

The southeast 5 feet of the northeast 108 feet of the vacated alley lying between Lot 20 and Lots 16, 17, 18, & 19, Block 18, Plat of Worthington, City of Worthington, Nobles County, Minnesota.

Vacation of Public Right-Of-Way - Newport Laboratories has requested the vacation of the Circle Drive public right-of-way between Spring and East Avenues. The legal description of the right-of-way is as follows:

Circle Drive from 50 feet west of the westerly right-of-way line of Spring Avenue and the northerly right-of-way line of East Avenue.

Text Amendment - JBS Swift has submitted an application to amend Title XV, Section 155 of the City Code to increase the maximum structure height allowed in "M-2" - General Industrial from 70 feet to 100 feet.

The public hearings will be held in the City Council Chambers, at City Hall, 303 Ninth St., Worthington, Minnesota, at 7:00 P.M. on Tuesday, July 6, 2010. At the hearings, the Planning Commission will hear staff's report and public testimony and may take action. All interested persons are invited to attend and be heard.
