The County Board of Nobles County met in regular session this date with the following members present: Marvin Zylstra, Diane Thier, Norm Gallagher, David Benson and Vern Leistico.

The Pledge of Allegiance to the flag was recited.

On a motion by David Benson and seconded by Marvin Zylstra, it was duly passed to approve the agenda as amended.

On a motion by Norm Gallagher and seconded by Vern Leistico, it was duly passed to approve the Official Proceedings of the September 23rd, 2008 County Board meeting and September 30th, 2008 Special Board meeting.

Steve Schnieder, Public Works Director, presented the Board with information and a recommendation in the area of public works.

Mr. Schnieder gave an update on the status of Judicial Ditch #8, the proposed work and an estimated cost of the work. Persons in attendance were allowed to comment. The Board directed Mr. Schnieder to contact the Minnesota Department of Transportation to discuss the issue and the possibility of financial responsibility from the State.

On a motion by Vern Leistico and seconded by David Benson, it was duly passed authorize the request to receive quotes for the replacement of a timber box culvert that was damaged by fire.

On a motion by David Benson and seconded by Vern Leistico, it was duly passed to adopt the following resolution:

WHEREAS, the County of Nobles is planning on implementing a Township Bridge Project in 2008 which will require State Aid Funding in excess of those available in its State Town Bridge Account, and

WHEREAS, said county is prepared to proceed with the construction of said project through the use of advanced encumbrances from the general Township Bridge Account, and

WHEREAS, repayment of the funds so advanced will be made in accordance with Minnesota law and Minnesota Rules, Chapter 8820.

NOW, THEREFORE, BE IT RESOLVED, That the Commissioner of Transportation be and is hereby requested to approve this advance for financing approved Township Bridge Project of Nobles County in an amount up to $60,000 in accordance with Minnesota Rules 8820.1500, Subparagraph 9, and to authorize repayment from the following year's accruals to the Township Bridge Account of the County State Aid Highway fund for said county.

On a motion by Marvin Zylstra and seconded by Vern Leistico, it was duly passed to authorize the County Administrator to sign, on behalf of Nobles County, a snow removal agreement with Mike's Mini Excavating, Okabena for snow and ice removal on parking lots and access roads at the Prairie Justice Center and Nienkerk Construction, Worthington for the Government Center and War Memorial Building parking lots.

Gary Prins presented the Board with information and concerns on two proposed roundabouts and access from Armour Road and the Travel Center on Minnesota 60 at Oxford Street and Interstate 90. Mr. Prins felt the proposal would be a detriment to current businesses in the area. The Board directed County Administrator, Melvin Ruppert, to schedule a joint meeting with the Worthington City Council to discuss the MnDOT proposal.

Mr. Schnieder updated the Board on structural concerns with the Larkin Township Bridge and his recommendation to close it due to safety concerns.

Sharon Balster, Auditor-Treasurer, presented the Board with information and recommendations in the area of the 2009 ditch maintenance.

On a motion by David Benson and seconded by Marvin Zylstra it was duly passed to approve and order spread the following ditch maintenance assessments collectible in the year 2009:
