Fulda couple, once accused of filing fraudulent tax returns, now accused of using those to obtain loans

WORTHINGTON — A Fulda man charged last year along with his wife for allegedly filing false or fraudulent income tax returns now faces additional charges in Nobles County District Court.

According to a criminal complaint filed Thursday, Philip Kramer, 39, obtained nearly $500,000 in loans from First State Bank Southwest in Worthington over an approximately three-year period by providing false or misleading information. The misleading information, the complaint alleges, was Kramer’s submission of portions of his Minnesota State income taxes for 2013, 2014 and 2015 that are accused of being fraudulent.

Kramer and his wife, Brittney, 33, were charged last June in Murray County District Court in relation to the latter offense. That complaint accuses the couple of failing to declare $320,540.86 in income on their joint Minnesota state income tax returns, resulting in a failure to pay $21,598.54 in taxes.

According to the complaint filed by the Nobles County Attorney’s Office, Philip and Brittney applied together for several loans over more than a two-year period at First State Bank Southwest in Worthington. As a result, they were granted $484,000 in loans from early 2015 to 2018 to invest in their farming operation.

As part of the investigation, officials at First State Bank Southwest told law enforcement that they use the tax returns to verify the number in other financial statements. Those numbers are then used as a tool to estimate future financial trends and to determine whether or approve loans.  

As a result, Philip Kramer faces six counts of felony theft by swindle and three counts of felony fraud in obtaining credit-money or property. The felony theft by swindle counts hold a maximum punishment of 20 years imprisonment, a $100,000 fine or both. As of Friday afternoon, Brittney had not been charged related to the accused offense.

However, disposition is still pending on both Philip and Brittney’s charges related to allegedly filing fraudulent tax returns.

A July 30 jury trial has been scheduled for both Kramers if an agreement is not reached sooner.
