WORTHINGTON — A Worthington man accused of strangling and assaulting a woman while he was intoxicated is facing charges in Nobles County District Court.
According to the criminal complaint, Worthington police officers responded to a domestic situation at a Worthington residence after 3 p.m. Saturday. The complainant reported that Jose F. Montoya-Garcia, 39, kicked her leg, pulled her hair and prevented her ability to breathe. She reported Montoya-Garcia eventually released his grip from around her neck, but then attempted to strangle her again. She was able to push him away.
Officers reportedly observed red markings on the victim's neck and a swollen and bruised eye.
Montoya-Garcia reportedly denied that a physical altercation had occurred, but officers observed scratches on the defendant's chest, the complaint concludes.
Montoya-Garcia has been charged with felony domestic assault — by strangulation and domestic assault, a misdemeanor.
His conditional bail was scheduled at $1,000; his conditional $5,000.
