SPIRIT LAKE, Iowa -- A trial scheduled for an Iowa man accused of manslaughter may not take place as planned next week, according to court documents.
Kenneth George Neilson, 59, was arrested July 29, 2007, after his .357 hand gun allegedly discharged accidentally. The bullet reportedly went out a window and across a street, striking Marlan Lutterman of Worthington in the back. Lutterman died of his wounds a short time later.
A hearing on whether to postpone the trial yet again is on Monday's court calendar in Dickinson County District Court, the day before the trial is to begin.
The latest postponement request comes from the Dickinson County Attorney's Office because of a change in counsel. County Attorney Rosalise Olson is on medical leave, and Assistant County Attorney Jon Martin will handle the case, with help from the Iowa Attorney General's Office.
A hearing to discuss the postponement was supposed to take place July 14, but Neilson reportedly did not show up for court that day. An order signed by Judge David Lester states the hearing is continued until this Monday. The order states the defendant shall appear personally.

This trial has been rescheduled numerous times since Lutterman's death for a variety of reasons.
