NOTICE OF PUBLIC HEARING

The City of Worthington Planning Commission will hold two public hearings on Tuesday, August 7, 2007, for the purpose of considering the following Planning Commission business:

Variance - Gary Linder has submitted an application for a variance for property he owns at 406 Olander Street. If approved, the applicant will be able to encroach 3 feet into the required 10 foot side yard setback to construct a 10 foot addition to the east side of the house. According to the Zoning Ordinance, property zoned "R-1", which is the zoning classification for the subject property, principal structures, including single family dwellings, must be located a minimum of 10 feet from interior side property lines.

The legal description of the subject property under consideration is as follows: Lot 7, Block 5, Okabena Heights, an Addition to the City of Worthington, Nobles County, Minnesota.

Variance - Jose Maldonado has submitted an application for a variance for property he owns at 2027 East Clary Street. If approved, the applicant will be able to construct a new single family dwelling in the "B-3" - General Business District, which is the zoning classification for the subject property. According to the Zoning Ordinance, the existing single family dwelling is considered legally non-conforming or "grandfathered".

Such status allows the applicant to maintain the structure but it can not be enlarged, constructed, reconstructed or structurally altered except for a use permitted within the district. The legal description of the subject property under consideration is as follows: That part of the North Half of the Northeast Quarter of Section 24, Township 102,Range 40, bounded and described as follows, to-wit: Commencing at the point of intersection of the southeasterly boundary line of the right of way of the Chicago, St. Paul, Minneapolis and Omaha Railway Company, and the south line of said North Half of said Northeast Quarter of said Section 24; thence running east on said south line of said North Half of said Northeast Quarter, 300 feet; thence running north and at right angles, 290 feet, more or less, to said southeasterly boundary line of above right of way; thence running southwesterly and along said southeasterly right of way boundary line to the point of beginning, containing one acre, more or less. Subject to highway easement.

Also that part of the South Half of the Northeast Quarter of Section 24, Township 102, Range 40, bounded and described as follows, to-wit: Commencing at the point of intersection of the southeasterly boundary line of the right of way of the Chicago, St. Paul, Minneapolis and Omaha Railway Company, and the north line of said South Half of the Northeast Quarter of said Section 24; thence running east on the said north line of said South Half of said Northeast Quarter, 300 feet; thence running south and at right angles, 56 1/2 feet; thence running west and at right angles 359 feet, more or less, to said southeasterly boundary line of the above right of way; thence in a northeasterly direction along said southeasterly boundary line of the said Railway Company to the point of beginning, containing one half acre, more or less. Subject to highway easement.

The public hearings will be held in the City Council Chambers, at City Hall, 303 Ninth St., Worthington, Minnesota, at 7:00 p.m. on Tuesday, August 7, 2007. At the hearings, the Planning Commission will hear staff reports and public testimony and may take action. All interested persons are invited to attend and be heard.
