WORTHINGTON — Benjamin Murphy, 23, of St. James, will be supervised through electronic monitoring for the next two years for a December vehicle crash in which Murphy was accused of striking a light pole and driving through a neighbor's wooden fence.
Murphy was originally charged with two offenses, DWI and failure to notify owner of damaged property. When tested for the presence of alcohol, Murphy recorded a .19 blood alcohol content level — more than twice the legal limit.
As part of a plea agreement, Murphy pleaded guilty to DWI, and the other charge was dismissed. He received his sentence during a Tuesday morning hearing.
Fifth Judicial District Judge Darci Bentz sentenced Murphy to 335 days in local jail, with a stay of execution in favor of two years of supervised probation. Murphy will serve his probation term through electronic home monitoring. Barring any probation violations, he will not be required to serve any additional jail time.
Murphy was also ordered to pay a $500 fine.
